Los Jueces o Magistrados que rehusaren juzgar, pretextando silencio, oscuridad o insuficiencia de la ley, incurrirán en responsabilidad por denegación de justicia.
En los casos expresados, así como en los de falta absoluta de ley aplicable, se fundarán las resoluciones judiciales en los principios universales de equidad y de justicia.
