El apoderado o mandatario que en asunto judicial o administrativo, por cualquier medio fraudulento, perjudique la gestiónque se le hubiere confiado, o que en un mismo o diferentes asuntos defienda intereses contrarios o incompatibles surgidos de unos mismos supuestos de hecho, incurrirá en prisión de dieciséis (16) a setenta y dos (72) meses.

Si la conducta se realiza en asunto penal, la pena imponible se aumentará hasta en una tercera parte.

NOTA: penas aumentadas por el artículo 14 de la ley 890 de 2004 (vigencia a partir del 1° de enero de 2005)
