Traslado de testigos. La parte que solicita el testimonio de persona que no se halle en el lugar donde se sigue el juzgamiento, deberá sufragar los gastos de transporte y la permanencia del testigo en el lugar donde debe declarar. Si no lo hiciere, l a persona no estará obligada a compa recer. Estará exenta de la obligación prevista en el

inciso anterior, la parte que demuestre hallarse en imposibilidad de cumplirla.
