Los asignatarios a título universal, con cualesquiera palabras que se les llame, i aunque en el testamento se les califique de legatarios, son herederos: representan la persona del testador para sucederle en todos sus derechos i obligaciones transmisibles.

Los herederos son tambien obligados a las cargas testamentarias, esto es, a las que se constituyen por el testamento mismo, i que no se imponen a determinadas personas.
