El funcionario empleado público o trabajador oficial encargado de investigar, juzgar o custodiar a personas comprometidas en delitos o contravenciones de que trata el presente Estatuto, que procure la impunidad del delito, o la ocultación, alteración o sustracción de los elementos o sustancias decomisados o facilite la evasión de persona capturada, detenida o condenada, incurrirá en prisión de cuatro (4) a doce (12) años, pérdida del empleo e interdicción de derechos y funciones públicas por el mismo término. Si el hecho tuviere lugar por culpa del funcionario o empleado oficial incurrirá en la sanción respectiva, disminuida hasta la mitad.
