En caso de que un funcionario hubiere cumplido todos los requisitos legales para ser ascendido y el ascenso no se produjere por falta de vacantes, el excedente de tiempo de servicio en el cargo que desempeñe, hasta por un (1) año, se computará como tiempo servido en el cargo inmediatamente superior.
