El que en presencia de varias personas ofenda a otro en su honor, reputación o dignidad, será castigado con prisión por tres a diez días, y multa de cinco a cuarenta pesos.

Si el delito se comete en un acto público o por escritos o dibujos divulgados o expuestos en público, o por otro medio cualquiera de publicidad, la pena será la de prisión por veinte días a cuatro meses, y multa de treinta a ciento cincuenta pesos.
