Cuando se trate de infracciones cometidas, conjuntamente, por agentes sometidos a la jurisdicción militar y por particulares que no lo estén, debe sacarse copia de lo conducente y enviarse a los funcionarios competentes de la justicia ordinaria, para el juzgamiento de los últimos y salvo las excepciones establecidas en este Código.

Cuando la pena no este señalada en el Código Penal común, se impone la correspondiente prevista en este Código,
