Si a causa de las lesiones inferidas a una mujer encinta sobreviene un parto prematuro, que tenga consecuencias nocivas para la salud de la agredida o del producto de la concepción, la pena será de dos a cuatro años de presidio.

Si se produce el aborto, la pena será de dos a siete años de presidio.

En los casos previstos en los dos incisos anteriores se impondrá también multa de cien a dos mil pesos.
