El consejo de Guerra, cuando el sindicado sea oficial superior o sus equivalentes navales, estará presidido por el Director del ejército o el de la Armada Nacional o el Comandante Superior de la Fuerza Aérea Colombiana, o pro el oficial que lo reemplace, y a falta de estos, por el oficial superior que designe el Ministerio de Guerra.
