Conocen del incidente sobre recusación de un Magistrado los demás que forman la Sala respectiva.

Si se trata de un Juez y hay varios del mismo ramo y categoría, conoce del incidente el que sigue en turno, atendido el orden numérico; si no los hay, entiende en el asunto el respectivo suplente, y éste, o el designado por el turno, aprehenden el conocimiento del negocio principal, llegado el caso.
