El colombiano, aunque haya perdido la calidad de nacional, o el extranjero que deba obediencia a la Nación, a causa de su empleo o función pública, que tome parte en actos de hostilidad militar contra la Patria, o se ponga al servicio del enemigo exterior en el caso de un conflicto armado, está sujeto a la pena de presidio por diez a veinte años.
