Para la validez de la confesión es indispensable que el hecho confesado sea lícito y físicamente posible, que la ley no exija para el caso otro medio de prueba, y que quien la rinda se halle en el uso de su razón y sea persona capaz de contraer la obligación de cuya comprobación se trata.
