Incurre en separación temporal de dos meses a dos años:

1° El que por descuido, negligencia o falta de previsión, cause perjuicio en los elementos de la defensa nacional que le estén confiados, siempre que el hecho no constituya infracción de mayor gravedad;

2° El que cobre en beneficio personal o de terceros, por transporte de personas, o de carga, en naves aéreas, marítimas o fluviales.
