Art. 5.º Será castigado con la pena que señala el articulo 1.º todo funcionario público, todo Agente del Gobierno ó cualquiera persona que, encargada ó instruida oficialmente, por razón de su estado, del secreto de una negociación ó expedición, lo haya entregado á los Agentes de una Potencia extranjera ó del enemigo, con el fin de dañar el país.
