° Ningún arrendador podrá exigir al arrendatario la entrega de la finca, ni aun en el caso: de vencimiento del contrato de arrendamiento, si el arrendatario hubiere cubierto los respectivos cánones de arrendamiento en su oportunidad. Se exceptúan los casos en que el propietario haya de ocupar para su propia habitación o negocio el inmueble arrendado, o haya de demolerlo para efectuar una; nueva construcción. En este caso el arrendador deberá solicitar la licencia respectiva al Ministerio de Fomento, que dictará una resolución motivada autorizando o negando Ib. solicitud. Contra esta resolución caben los recursos légales.
