ARTICULO 217 . Competencia del superior . El recurso de apelación y la consulta permiten al superior decidir sin limitación alguna sobre la providencia impugnada o consultada. Cuando se trate de sentencia condenatoria no se podrá agravar la pena impuesta salvo que el fiscal, el agente del Ministerio Público o la parte civil, cuando tuvieren interés, la hubieren recurrido.
