Art. 186. Cuando la culpa no sea enteramente del Juez, como en el caso de ilegitimidad de la personería de la parte, á quien el Juez ha admitido como tál sin deber admitirla, ó en cualquier otro caso en que el Juez haya debido advertir la irregularidad en que se incurría, el pago de las costas corresponderá por mitad al Juez y á la parte culpable.
