De conformidad con el artículo 17 del Decreto 1750 de 2003, los servidores públicos a quienes se les tuteló el derecho en la Sentencia T-041 de 2005 quedan incorporados automáticamente sin solución de continuidad, en la planta de personal de la Empresa Social del Estado Policarpa Salavarrieta, y tienen derecho a percibir la prima individual de compensación de que trata el Decreto 1752 de 2003, en la medida en que cumplan los requisitos para tal fin.
