Art. 9.° Los colombianos que al tiempo de su invalidez o muerte no(tuvieren grado militar determinado, serán asimilados por el Poder Ejecutivo nacional, si hubieren prestado servicio en el ejército nacional, o por el Poder Ejecutivo del respectivo Estado, si hubieren hecho parte de las milicias al servicio de la Union, a la clase que estimaran que les correspondía, tanto por los servicios prestados como por las aptitudes de la persona de quien se trate, i las circunstancias en que recibiera la herida que le ocasioné la invalidez o muerte.
