Cuando se procediere a conceder o negar el recurso sin el avaluó pericial de que trata el artículo 4°, cualquiera de las partes podrá pedir que se practique esa diligencia, y si llegare a la Corte un proceso en que se hubiere prescindido del avaluó de la acción en el caso que prevé el artículo citado, serán devueltos los autos para que el inferior cumpla con lo dispuesto en el artículo.
