Articulo 4º. El artículo 9º del Decreto - ley 955 de 1970 queda así: Articulo 9º. Prescripción de la acción. La acción penal por el delito de contrabando prescribe en cinco años, que empezaran a correr en la forma señalada por el artículo 106 del código Penal. Cuando se desconozca la fecha de realización del hecho, la prescripción empezara a correr desde aquella en que se haya aprendido la mercancía.
