Garantías Marítimas

Ley 2133 de 2021 · por medio de la cual se establece el régimen de abanderamiento de naves y artefactos navales en Colombia y se disponen incentivos para actividades relacionadas con el sector marítimo.

Las garantías marítimas de las naves y artefactos navales con arqueo bruto superior a 500 toneladas a los cuales se refiere la presente ley se regirán por la Decisión 487 del Acuerdo de Cartagena sobre Garantías Marítimas (Hipoteca Naval y Privilegios Marítimos) y Embargo Preventivo de Buques o por las normas que la modifiquen o reemplacen.

Las garantías marítimas de las demás naves y artefactos navales se regirán por el Código de Comercio. En caso de no existir norma aplicable, las garantías marítimas se regirán por las normas internacionales que rijan la materia.
