Propiedad de la marca de certificación. La Marca de certificación de que trata el artículo 16 de la Ley 2125 de 2021, es propiedad exclusiva y excluyente de la Nación, en cabeza del Ministerio de Comercio, Industria y Turismo. El Ministerio podrá ejercer, directamente o a través de terceros, todas las acciones pertinentes para proteger la marca de certificación de utilizaciones indebidas, abusivas, fraudulentas, engañosas o no autorizadas, con el fin de preservar su imagen y propender por el cumplimiento de los fines propuestos en la Ley 2125 de 2021, y en esta reglamentación.
