Los delitos de abandono del puesto, deserción y abandono del servicio, se tramitarán y fallarán por el procedimiento siguiente: recibido el parte, denuncia, aviso o informe, el Juez de primera instancia perfeccionará la investigación dentro de los ocho días siguientes. Si no fuere posible recibir indagatoria al sindicado dentro de tal término se le emplazará por dos días se le designará defensor de oficio. Vencido el término anterior o perfeccionada la investigación, se dará traslado para concepto de fondo al Fiscal por veinticuatro horas y al defensor para alegato por igual término. Devuelto, se pronuncia el fallo dentro de los tres días siguientes. Capítulo IV De la Segunda Instancia.
