Article 5

Las Entidades Competentes Negarán O Aprobarán La Solicitud De Modificación Presentada Por La Sociedad Portuaria, Previa Validación Positiva De Su Viabilidad Técnica, Financiera Y Jurídica Por Parte De Su Consejo Directivo O Su Órgano Equivalente En Cada Caso, Siempre Y Cuando Con Ello No Se Infiera Perjuicio Grave E Injustificado A Un Tercero Y No Tenga Un Impacto Ambiental Negativo

°. Las entidades competentes negarán o aprobarán la solicitud de modificación presentada por la sociedad portuaria, previa validación positiva de su viabilidad técnica, financiera y jurídica por parte de su consejo directivo o su órgano equivalente en cada caso, siempre y cuando con ello no se infiera perjuicio grave e injustificado a un tercero y no tenga un impacto ambiental negativo.

Parágrafo

Las sociedades portuarias deberán aceptar los términos y condiciones que a través de las entidades administradoras del contrato señale el Gobierno Nacional, para efectos de conceder la modificación propuesta.
