Art. 5. Si ni aun así puede formarse el tribu- nal marcial de que trata el artículo anterior, entón- ces se pasarán el reo i la causa a la Comandancia jeneral mas inmediata para que se reuna el consejo como está prevenido por las disposiciones de esta lei.
