Si el contrato termina por incumplimiento del propietario, el aparcero queda eximido de reintegrar el valor de los anticipos y, con derecho a percibir del propietario un valor igual al del anticipo, a título de indemnización sin perjuicio de los demás derechos que le otorga la presente Ley.
