Inversión con recursos públicos en predios privados. La infraestructura necesaria para los proyectos para el acceso al agua y el saneamiento básico que vaya a ser administrada por un GC podrá construirse en predios privados, siempre que se constituyan de manera previa las respectivas servidumbres en favor de la entidad territorial. Para estos efectos, serán aplicables las reglas de aporte bajo condición estipuladas en el artículo 2.3.8.3.5 del presente decreto.

Parágrafo

En todo caso, la entidad territorial deberá tomar las acciones necesarias para garantizar el disfrute y uso efectivo de las servidumbres constituidas, a fin de que el GC pueda administrar adecuadamente la infraestructura construida en predios privados.
