Prejudicialidad extrapenal. Cuando la existencia de alguno de los elementos constitutivos del delito dependa de la solución de un proceso extrapenal preexistente a las comisión del hecho, no se dictará sentencia mientras no se hayan decidido las cuestiones previas. No obstante si transcurrido un año desde la oportunidad para dictar. sentencia, no se hubieren decidido definitivamente las cuestiones que determinaron la suspensión, se dictará el fallo correspondiente.
