Art. 25. La excepción de ilegitimidad de la personería puede tener lugar en los casos siguientes:

1.° Cuando el demandante no sea hábil para comparecer en juicio, según lo dispuesto en el Capítulo "Demandante y demandado";

2.° Respecto del apoderado, albacea, guardador, síndico y demás personas que gestionan á nombre de otras que acrediten su representación; y

3.° Para que se pruebe la identidad que establece la demanda.
