Terminada la indagatoria o vencido el termino señalado en el articulo anterior, la situación jurídica del capturado deberá definirse a mas tardar dentro de los cinco días siguientes, decretando la detención preventiva, si hubiere prueba que la justifique, u ordenando su libertad. En este último caso, si subsiste algún indicio contra el indagado, el Juez podrá imponerle la obligación de presentarse periódicamente a su despacho, so pena de multa hasta por quince pesos.
