Si ante la ausencia del investigado la notificación del auto de cargos se surtió por edicto, cumplidos los términos legales para responder dicho auto se dejarán las constancias respectivas y de inmediato se procederá a designar un defensor de oficio, a quien se le notificará del auto de cargos, que debe ser respondido en el término de diez (10) días, y con quien se continuará el trámite procesal.
