Cuando el proponente ejercite la facultad consagrada en el último inciso del artículo 34, sobre modificación de la propuesta antes del envío del expediente a la Corte Suprema de justicia se dejará en el Ministerio de Minas y Petróleos copia de la actuación pertinente para la tramitación de la propuesta modificada. Si el fallo de la corte fuere favorable a la Nación, la zona materia de la oposición quedará incorporada en el contrato, en cuyo texto deberá incluirse una estipulación sobre este particular.
