Si la obligación fuere de entregar cosa de género y de pagar perjuicios no determinados en cantidad líquida por estipulación, éstos se estimará por el ejecutante en la demanda con protesta de estimación equitativa, en cantidad mensual en dinero desde que hubiere empezado la mora hasta la entrega de la cosa o pago de su precio.
