Si el demandado tiene apoderado, se cita a éste para que dentro de los tres días siguientes se presente a ejercer la representación, exhibiendo el comprobante de ella si no aparece de autos. Si el apoderado no comparece o se niega a ejercer el poder, se nombra curador previos los trámites indicados en el primer inciso del artículo precedente.

Es valídala actuación en que intervenga curador por ignorarse la existencia del apoderado.
