El titular de la patente y el beneficiario de una licencia podrán ejercer conjunta o separadamente las acciones legales que sean del caso en la defensa de los derechos que confiere la patente.

Cuando la demanda la inicia el beneficiario de la licencia deberá notificarse personalmente, al titular de la patente.
