º El artículo 16 del Decreto 1853 de 1985, quedará así: EXCEPCIONES A LAS NORMAS SOBRE LIBERTAD PROVISIONAL. No tendrán derecho a la libertad provisional prevista en el numeral 3º del artículo 44 de la Ley 2º de 1984

Los procesados por delitos de secuestro extorsivo, extorsión y terrorismo, por los delitos tipificados en el Estatuto Nacional de Estupefacientes cuando tengan pena de prisión que sea o exceda de dos (2) años y por los delitos de enriquecimiento ilícito y los consagrados en el Capítulo I, Titulo VII del Código Penal y en el Decreto número 2920 de 1982.

Los procesados a quienes se les hubiere dictado auto de detención preventiva conforme a lo previsto en los numerales 4º y 5º del artículo 14 del Decreto 1853 de 1985.
