Artículo quinto. Empresa de transporte automotor es la persona natural o jurídica que se dedica, mediante un precio, al transporte de pasajeros o carga o de pasajeros y carga por las carreteras y calles de uso público, en uno o más vehículos de su propiedad, o que no siéndolo se encuentren al servicio de la empresa bajo su administración, control y responsabilidad.
