Art. 2216. El comodante es obligado a indemnizar al comodatario de las expensas que sin su previa noticia haya hecho, para la conservación de la cosa, bajo las condiciones siguientes:

Si las expensas no han sido de las ordinarias de conservación, como la de alimentar al caballo.

Si han sido necesarias i urgentes, de manera que no haya sido posible consultar al comodante, i se presuma fundadamente que teniendo éste la cosa en su poder no hubiera dejado de hacerlas.
