El Presidente del Consejo de Guerra que conoce de causas por deserción, vota los cuestionarios en la misma forma que los vocales. Realizada la votación y terminado el escrutinio, la causa queda lista para sentencia. El Presidente entrega el expediente al auditor de guerra para que redacte la sentencia en el término de veinticuatro horas.
