Si la lesión produce enfermedad o incapacidad para trabajar, que no pase de quince días, la pena es de seis meses a dos años de arresto. Si la enfermedad o la incapacidad pasa de quince días, sin exceder de treinta, la pena es de uno a cuatro años de prisión.

Si la enfermedad o la incapacidad pasa de treinta días, la pena es de diez y ocho meses a seis años de prisión.
