El explotador sólo quedará libre de la obligación de pagar la regalía cuando el Gobierno reciba efectivamente el petróleo crudo en especie, o cuando se haya dado cumplimiento a lo dispuesto en el inciso final del artículo 12. La obligación establecida para el explotador en la parte primera del inciso 3º del mismo artículo 12 se hará efectiva, sea que haya asegurado el petróleo o sea que no lo asegure. Es entendido que el aseguro que haga el explotador será siempre a su costa.
