Art. 16. Para ser Magistrado de la Corte Suprema se requiere ser colombiano de nacimiento y en ejercicio de la ciudadanía, haber cumplido treinta y cinco años de edad y haber sido Magistrado de alguno de los Tribunales Superiores de Distrito ó de alguno de los antiguos Estados, ó haber ejercido con buen crédito, por cinco años á lo menos, la profesión de abogado ó el profesorado en jurisprudencia en algún establecimiento público.
