Para los ascensos dentro de la Justicia Penal Militar, se tendrá en cuenta en todos los casos el siguiente orden jerárquico: 1º Procurador Delegado en lo Penal, Magistrados del Tribunal Superior Militar, Fiscales del mismo y Auditores de Guerra Superiores; 2º Auditores de Guerra Principales y Jueces de Instrucción Penal Militar; 3º Auditores de Guerra Auxiliares.
