La disponibilidad procede a solicitud del funcionario, quien, salvo fuerza mayor o caso fortuito deberá solicitarla con una antelación no inferior a un mes respecto a la fecha en que desee comenzar a hacer uso de ella. Si transcurre este término sin haberle sido decidida su solicitud, el funcionario no podrá hacer dejación del cargo salvo fuerza mayor o caso fortuito.
