Para estimar las capacidades de producción anual de que trata el artículo 195 de este Decreto, se tendrán como base los estudios de exploración técnica, de reservas probadas y probables, los proyectos de montaje, explotación y transformación, previamente aprobados por el Ministerio de Minas y Energía. Estos estudios y proyectos deberán referirse a todas las áreas colindantes o próximas que la empresa vaya a explotar en cualquier forma directa o indirectamente.
