ARTICULO 342. Desistimiento del ofendido. Si la lesión solo produjere incapacidad para trabajar o enfermedad que no pase de treinta días, la acción penal se extinguiera a petición del ofendido, excepto. 1o. cunado concurriere alguna de las circunstancias de agravación prevista en el artículo 330 distintas de las señalada en el ordinal primero, y 2o. Cuando el ofendido fuere o hubiere sido empleado oficial y el delito se cometiere por razón del cargo o del ejercicio de sus funciones.
