Las únicas causales de impedimento o recusación para Jueces, Fiscales y Magistrados, en los procesos militares, son las siguientes:

1° Parentesco de consanguinidad dentro del cuarto grado o. segundo de afinidad, entre el Juez, el Fiscal o Magistrado y el procesado;

2° Enemistad grave entre las mismas personas;

3° Tener interés directo y personal o haber declarado come testigo en el proceso.
