Los contratos que celebre la Empresa para el desarrollo de sus actividades no estén sujetos, salvo disposiciones en contrario, a las formalidades que la Ley exige para los del Gobierno. Las cláusulas que en ellos se incluyan, serán las usuales para los contratos entre particulares, pero la Empresa podrá, en los términos del artículo 254 del Código Contencioso Administrativo, pactar el derecho a declarar administrativamente la caducidad y deberá incluir, cuando fuere el caso, las prescripciones pertinentes sobre reclamaciones diplomáticas.
